When is a Registered Putative Father's Consent to Adoption Unnecessary in Ohio
By Erik L. Smith, Paralegal
The article describes in depth the law in Ohio, as of July 1, 2008, about when probate courts find a registered putative (non-legally established) father's consent unnecessary under R.C. 3107.07 for abandonment or failure to support the mother or child adequately. The article concerns only fathers of the child who have registered timely with the Ohio Putative Father Registry. The relevant part of R.C. 3107.07 states:
"Consent to adoption is not required of...
(B) The putative father of a minor if either of the following applies:
(2) The court finds, after proper service of notice and hearing, that any of the following are the case:
(a) The putative father is not the father of the minor;
(b) The putative father has willfully abandoned or failed to care for and support the minor;
(c) The putative father has willfully abandoned the mother of the minor during her pregnancy and up to the time of her surrender of the minor, or the minor’s placement in the home of the petitioner, whichever occurs first."
